2016 OFF SUNSET FESTIVAL
RULES & REGULATIONS
I. GENERAL GUIDELINES FOR THE FESTIVAL
The 2016 Off Sunset Festival (hereinafter “Festival”) is excited about being a Silverlake tradition. Attendees spend the day on Santa Monica Boulevard enjoying the local culture, Food, and Music of our vibrant and diverse community. The Festival is 21 and over.
Every exhibitor must submit an application online, and exhibitor participation in the Festival is contingent on acceptance of the application according to the rules and regulations set out below. Space is limited and subject to jury approval.
Exhibitor registration will close March 27, 2016.
Festival hours are from 11:00 a.m. to 7:00 p.m. Exhibitors must cease selling at 7:00 p.m. without exception.
II. APPLICATION PROCESS
To participate in the Festival, exhibitor must complete the online application, submit minimum of (2) photos of the products being sold, a minimum of (1) photo of the booth layout with product, and submit the required fees. Payment will not be processed until exhibitor is accepted by jury committee.
In order to effectively jury all exhibitors we must have some visual representation of how you will be displaying your goods at the festival.
All applications are subject to committee approval. Application selection is under the sole discretion of the committee and is not subject to review or appeal. The committee reserves the right to reject any application and to demand the release of any rented space at any time before or during the Festival for failure to conform to these Rules & Regulations.
Off Sunset Festival prides itself on showcasing artist/artisan made works. Preference will be given to exhibitors that create goods that are unique, original, well made, and hand-crafted. Booths should not be overly commercial in appearance.
Commercial Business Exhibitors
There are many multiple options for commercial businesses, whether they are interested in exhibitor space or interested in being supporting sponsors. Additionally, there are discount opportunities for Commercial Exhibitors that support a eco-conscious Lifestyle through their products or business. 501(c)3: Applicants may pay a discounted rate if they provide proof of 501(c)3 non-profit status as defined by IRS regulations. For IRS rules, please read:. http://www.irs.gov/charities/charitable/article/0,,id=96099,00.html.
Community/Govt. Organizations Table
Non-profit, Community or Government organizations that do not fall under the 501(c)3 criteria may apply at a discounted rate as part of a shared community organization area or they may rent at the Handcraft rate. The Community tables will be in 10x10 canopies with table space for 2 Organizations.
A blanket late fee in the amount of 10% will be applied automatically to any Exhibitor that registers after 11:59 p.m. on March 20, 2016.
No refunds will be made on withdrawals from the festival.
III. BOOTH MAINTANENCE
Booth set up begins promptly at 8:00 a.m Exhibitors will not be permitted to begin setting up their booths prior to 8:00a.m. Vehicles may unload goods and the Blvd must be cleared by 10 a.m. or they will be subject to towing.
The Festival ends at 7 p.m.
**Please note vehicles will not be allowed on the street until Los Angeles Police Department has deemed it safe. This process must be followed to insure the Blvd is safely cleared of pedestrians prior to allowing vehicles to enter.
PARKING IS NOT PROVIDED.
BOOTH SIZE & SPACE RESTRICTIONS
All booth spaces (except Community information tables) are rented as a single unit consisting of 10’ X 10’ canopy tent. No sidewalls, tables or chairs will be provided. No partial booths will be sold, but Exhibitors may share a single booth space provided that the application contains information and photos of both applicants. The combined merchandise will be subject to jury approval.
All exhibitors must sell their goods or represent their organization within their rented booth space. Booth inventory must be contained in the assigned space/site provided. No person, chairs, signs or other items from Vendors space/site may block an aisle or another space/site. Violation will be subject to a penalty of $250. Multiple booths side by side may be purchased. Exhibitors may not move to another location without permission from the Festival officials in charge of booth assignments, and may not occupy open spaces without paying for said space. No roving is allowed.
OSA does not provide electrical hookups, electrical outlets, power strips, easels or water. All Exhibitors must supply their own display tables, counters, racks, easels, banners and seating. All Exhibitors must clean and maintain their areas throughout the day and leave their space free of debris.
Exhibitors must use recyclable bags (such as paper, compostable or bio-degradable bags) NO PLASTIC BAGS may be given to customers! Please contact us if you have questions or are interested in purchasing compostable bags.
Fire Inspector approved canopies will be provided. NO EXHIBITOR OWNED CANOPIES WILL BE ALLOWED . ALL CANOPIES MUST BE PROVIDED BY OFF SUNSET FESTIVAL PER THE LOS ANGELES FIRE DEPARTMENT.
No burning of any materials, including candles and incense will be permitted due to Los Angeles City and County fire regulations.
Exhibitor sites are subject to Los Angeles Fire Department inspection and if fire codes are not met, exhibitors will be subject to removal from the festival and/or citations.
Any required permits, with the exception of the LA County Health Department permits required for food exhibitors, needed to participate in the Festival are the assumed responsibility of the Vendor. Vendors shall be responsible for collecting and reporting taxes. For more information about collecting and reporting state taxes and/or to obtain a resale number, contact the local office of the State Board of Equalization or call 800-400-7115.
IV. GENERAL LIABILITY
Exhibitors are responsible for their own money, taxes, and licenses. All Participants and Exhibitors are responsible for their own display; the City of Los Angeles, the Off Sunset Association, and the Off Sunset Festival Committee shall not be held liable for any damage or loss to property belonging to Participants or Exhibitors. See “LIABILITY WAIVER” section for further explanation.
V. CODE OF CONDUCT
The Festival Committee expects all participants, whether they be Exhibitors, musicians, or members of the public, to conduct themselves in a peaceable and lawful manner. Any person found acting in an unreasonable, abusive, violent, belligerent, loud, or offensive manner will be in violation of these Rules and Regulations and asked to leave the Festival. If a violating person refuses to leave, he or she may be removed by the Los Angeles Police Department officers and be subject to possible arrest and detention. All individuals will be expected to obey all laws, Municipal, State and Federal.
Alcohol may be sold only in businesses or sanctioned areas that have legal permits to sell alcohol. The sale and consumption of alcohol must conform to all State and Municipal laws. Exhibitors in violation of the law may be subject to penalties, including booth closure, forfeiture of fees, and possible arrest.
BOOTH CLOSURE AND SHUT DOWN
Exhibitor booths may be shut down for violations of these Rules and Regulations, any violation of State or Municipal law, or for just cause within the Festival Committee’s discretion. Exhibitors may be shut down and their booths closed by any official department or government agency, such as the LAFD or LAPD.
FORFEITURE OF FEES
If an Exhibitor is shut down due to a violation of the OSA Rules and Regulations outlined here all fees will be forfeited.
The Festival Committee has the right to bar any Exhibitor from participation in future Festivals. Violation of any of these Rules and Regulations may result in being barred from participating in future festivals.
VII. GENERAL NON-LIABILITY CLAUSE
All Participants and Exhibitors are responsible for their own display; the City of Los Angeles, the Off Sunset Association, and the Off Sunset Festival Committee shall not be held liable for any damage or loss to property belonging to Participants or Exhibitors.
Vendor shall defend, indemnify, and hold harmless the City of Los Angeles, Off Sunset Festival Association, its officers and Festival Sponsors/Partners from any and all actions, suits, proceedings, claims, costs, and expenses, including attorney’s fees, for loss or damage to any items displayed for sale or any equipment.

2016 Off Sunset Festival Liability Waiver
(Please initial beside each paragraph and sign below)
____I/we hereby release the Off Sunset Festival Association and any and all directors, agents, employees of the City of Los Angeles, agents, or employees of the County of Los Angeles, or the directors, members, employees, any sponsors of the Off Sunset Festival for any and all damages, injuries, or losses I/we may sustain or incur while participating in the aforementioned festival. This also includes property damage that might be sustained due to fire, theft, weather, public catastrophes or Acts of God.
____ I/we will obey the laws and applicable laws of The United States, The State of California, The City of Los Angeles, The County of Los Angeles, as well as all rules of the 2014 Off Sunset Festival. I/we understand that failure to do so may result in closure of my assigned booth and forfeiture of all fees.
____ I/we will obey all Los Angeles City and County fire codes, including but not limited to the use of fire retardant canopies/tents only. If an inspection is conducted and it is determined that I/we must forfeit our space due to any fire code violations I/we understand that all monies paid to Off Sunset Festival Association will be forfeited.
____ I/we consent that any photographs furnished by me/us or taken of me/us in connection to the 2016 Off Sunset Festival are the sole property of the Festival Committee and may be used for any publicity, promotion, video, or television showing without my knowledge or consent, and I/we waive any compensation in regard thereto.
____ I/we have read and fully understand the statements included in this waiver and acknowledge complete acceptance of them.
I have read and will comply with all the rules and regulations regarding the Festival.
I fully realize that neither the City of Los Angeles, nor the Off Sunset Association/Festival Committee in any way assumes responsibility for or is liable for any injury to any person or loss or damage to property before, during or after this Festival.
I understand that if any of the requested information and all applicable fees are not included with this application the application will not be processed until properly completed.
I will remain open between the hours of 11 a.m. thru 7:00 p.m. on Festival Day and will comply with all rules. I further understand that my participation in future Festivals is in jeopardy if all of the rules are not adhered to.
